1. SpotFlare Intellectual Property
- The SpotFlare name and brand
- The SpotFlare logo and all visual identity elements
- The "Follow the Flare" slogan and all SpotFlare taglines
- The Platform's software, source code, and technology
- The design, layout, and user interface of the Platform
- All SpotFlare-created content including copy, illustrations, marketing materials
- The shareable event card template and design
- All trademarks, service marks, and trade dress associated with SpotFlare
2. User Content Ownership
You retain ownership of the content you create on SpotFlare. By posting content you grant SpotFlare a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, display, reproduce, modify, and distribute your content in connection with operating and promoting the Platform. This license ends when you delete your content or account, subject to content already shared via event cards distributed by other users.
3. Copyright Policy — DMCA
3.1 Our Policy
SpotFlare complies with the Digital Millennium Copyright Act. We remove infringing content and may terminate repeat infringers.
3.2 Reporting Copyright Infringement
Send a DMCA notice to support@spotflare.app with subject "DMCA Copyright Notice." Include:
- A physical or electronic signature
- Identification of the copyrighted work
- Identification of the infringing material with enough detail to locate it
- Your contact information
- A good-faith belief statement
- A statement under penalty of perjury that the information is accurate
3.3 Counter-Notices
Send to support@spotflare.app with subject "DMCA Counter-Notice" including your signature, identification of removed content, a statement of mistake or misidentification under penalty of perjury, and your contact info plus consent to the jurisdiction of the federal court in Delaware.
3.4 Repeat Infringers
SpotFlare terminates accounts of repeat copyright infringers.
4. Trademark Policy
SpotFlare, the SpotFlare logo, "Follow the Flare," and related marks are trademarks of SpotFlare, Inc. You may not use them in any way likely to cause confusion or that implies endorsement without prior written consent. Report trademark infringement to support@spotflare.app with subject "Trademark Notice."
5. Shareable Event Cards and Branding
- SpotFlare branding on shared cards remains our IP
- You may share event cards for personal, non-commercial purposes
- You may not alter, obscure, or remove SpotFlare branding
- No commercial advertising use without prior written consent
6. License to Use the Platform
Subject to these Terms, SpotFlare grants you a limited, non-exclusive, non-transferable, revocable license to access the Platform for personal, non-commercial purposes. This license does not include the right to:
- Copy, modify, or distribute the Platform
- Reverse engineer or decompile any part of the Platform
- Remove copyright, trademark, or proprietary notices
- Build a competing product or service
- Scrape, crawl, or extract data through automated means
